Brit Fest 2008 Saga - Update Print E-mail

Further to our previous post on the Britfest 2008, Salsa-uk have released a statement in response to the original forums. Posted here is the Salsa-UK statement, along with the original statement from Emma and Kate Moore.

As before, please note that Salsa Central has no opinion on this story and continues to remain impartial

An official Statement from Paul Young on behalf of Salsa UK

"There has been much talk about the forthcoming BritFEST 1 – 3 February 08 not least because of the “Public Statement” by Kate and Emma Moore of Salsology sent on 12 October 2007.

Firstly, I would like to thank all of those who have sent messages of support or who recognise that there are two sides to any dispute both of which have to be aired before any conclusions are drawn. Secondly, I consider it very sad and regrettable that this dispute is being played out in the public domain but I have no choice but to defend my name and reputation from the inflammatory and misleading statements contained in Kate and Emma’s public announcement.

I will try to keep things brief and simple by sticking to the facts: -

1. “Brit Salsa Fest” whether at the Winter Gardens or not is not a partnership between Salsology and Salsa UK Limited.

2. There is no proper legal partnership of any kind, nor was there any intention to create one, although it is true that we put on two events at the Winter Gardens in February 2006 and February 2007.

3. The terms and conditions with the Winter Gardens (the venue) were negotiated by me before I approached Emma & Kate. Furthermore the venue contract belongs to and is in the name of Salsa UK only.

4. At the beginning of 2007 I discovered that Kate and Emma had started a company called Salsology T/A Brit SalsaFest Limited, in their own names, without consulting or notifying me in any way. A major factor that contributed to the irreconcilable breakdown in our relationship.

5. It is completely untrue to say that any injunction has been sought or served by Kate and Emma. Our own lawyers told their lawyers, in no uncertain terms, last week that any attempt to obtain an injunction would have to be made with my lawyers present and would be bound to fail. Nothing further has been heard.

6. I have tried to negotiate an amicable settlement to the dispute with Kate and Emma, but this was not proceeding in a realistic direction; and making public statements of the kind to which I am replying to is scarcely the correct approach to speed up a happy outcome.

7. Finally, neither Salsa UK Limited nor I have made any use of assets belonging to Kate or Emma Moore or Salsology.

I personally would like to reassure all customers who have booked for the event, or are thinking of paying a deposit, that we are fully entitled to put on this event, since the venue contract with the Winter Gardens belongs to and is solely in the name of Salsa UK.  We are also fully insured in the extremely unlikely event of a cancellation.

Even though I consider Kate and Emma Moore’s public statement of 12 October 2007 to be a misleading and mis-guided document I will continue to make every effort to negotiate a fair outcome for both parties.

Lastly it is in everyone’s interest in the Salsa community that the Congress in Blackpool Winter Gardens goes ahead as planned, not least for those teachers, performers and dancers for whom the event is a great opportunity to socialise, teach, perform and have a great time.

Brit Salsafest 2008 - A Public Statement by Kate and Emma Moore of Salsology

"Brit Salsafest at the Winter Gardens is a partnership between Kate and Emma Moore (of Salsology) and Salsa UK Limited (represented by Paul Young). The partnership operates on a 50/50 basis, and hosted two very successful events in February 2006 and February 2007.

On creation, the partnership agreed to work together to host three Brit Salsafest events. Whilst we (Kate and Emma Moore of Salsology) have sought to honour this agreement for 2008, we have been advised that Salsa UK is now seeking to manage and run this event without our further involvement.

Customers should be aware that Salsa UK is seeking to use assets belonging to the partnership to host this event. These assets include the BritFest name and dates (each of which is identified with the event) and the contract for use of the Winter Gardens. Our legal advice on this matter has been robust, and is that it is unlawful for Salsa UK to use the assets of the partnership in this manner, or to seek to host the event without our involvement.

Whilst negotiations have taken place between us and Salsa UK, an amicable resolution has not yet been achieved. In order to protect the assets of Brit Salsafest, we have regrettably been left with no option but to instruct solicitors to issue legal proceedings. Those proceedings are for an injunction to protect the assets of Brit Salsafest, and to prevent their use by Salsa UK acting alone. It is anticipated that these injunctive proceedings will be concluded shortly – and we will of course write to advise you of their outcome. In the meantime, Customers may wish to consider delaying the purchase of tickets for the 2008 event until this matter has been resolved by the Courts.

We wish to thank our loyal customers for their continued support and to let them know that we are doing our utmost to safeguard the existence of the Brit Salsafest event and the representation of a Northern promoter (through Salsology), in its management and ownership.
